What the law asks
Give every employee and worker a written statement of their particulars no later than the day they start. It must be one document, apart from the items the law lets you give separately.
Employment Rights Act 1996 ss.1-2Check the right to work of everyone you employ before they start, by one of the three prescribed routes, and keep a dated record for the employment and two years after. Since 1 October 2026 this also reaches people engaged on a worker's contract, individual sub-contractors and online matching services.
Right to work checks: an employer's guide, 1 October 2026Tell staff who you are, why you hold their data and on what basis, who receives it, how long you keep it, and their rights, including the right to complain to you and to the Commissioner.
UK GDPR Art.13Make a suitable and sufficient assessment of the risks to your employees and others, and review it when it may no longer be valid. With five or more employees, record the significant findings and any group especially at risk.
