What the law asks

  • Give every employee and worker a written statement of their particulars no later than the day they start. It must be one document, apart from the items the law lets you give separately.

    Employment Rights Act 1996 ss.1-2
  • With five or more employees, write down your health and safety policy, with who does what and how, keep it revised, and bring it and any revision to the notice of all employees.

Health and Safety at Work etc. Act 1974 s.2(3); SI 1975/1584
  • Check the right to work of everyone you employ before they start, by one of the three prescribed routes, and keep a dated record for the employment and two years after. Since 1 October 2026 this also reaches people engaged on a worker's contract, individual sub-contractors and online matching services.

Right to work checks: an employer's guide, 1 October 2026
